1. Acceptance of Terms

By accessing or using My Santa Letters ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

My Santa Letters provides personalized letters, text messages, and video messages from Santa Claus for children. The Service is intended for use by parents and guardians on behalf of their children.

3. User Accounts

You may be required to create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any purpose that is harmful to children.
• Provide false or misleading information.
• Arrange a message for anyone you do not personally know, or use the Service to harass, intimidate, or upset anyone.
• Attempt to interfere with or disrupt the Service.
• Use the Service in any way that violates applicable laws or regulations.

When you arrange a message for someone else, you confirm that you know them and that the message is meant kindly. You are responsible for the messages you arrange, and you agree to cover any claim that arises from misuse of the Service.

5. Content and Personalization

Messages generated by the Service are created using the information you provide. While we strive to create high-quality, appropriate content, you acknowledge that messages are generated with the assistance of artificial intelligence and should be reviewed by a parent or guardian before sharing with a child.

6. Payment and Refunds

Certain features of the Service require payment. All payments are processed securely through our third-party payment provider.

Before you approve anything, you can edit what Santa wrote or ask him to try again: up to five rewrites each for an email, text message or letter, and up to three changes to a video script. Once a video has been filmed, it is final. If you cancel before Santa has written anything for a child, we refund what you paid for that child in full. Once Santa has written for a child, we refund what you paid for that child minus a $1.50 processing fee. Once something has been sent or mailed, it can't be refunded. To cancel or ask for a refund, email support@mysantaletters.com.

7. Naughty List Messages

Naughty List messages, bought on their own or as part of a package, can be sent any time within 12 months from the date of purchase. The date of purchase is the day your payment is completed, and each message you buy on that day can be used until the same date one year later.

A message that has not been sent by then expires and can no longer be used. Your account shows how many messages you have left and when the next one expires.

8. Text Messages

If you order a Santa text message, you give us the mobile number it should go to. By saving that number you confirm that it is your number, your child’s number or a family member’s number, and that you agree to receive the message at it.

We send one text message for each text message you order, at the time you choose. We do not send marketing text messages. Message and data rates may apply.

Reply STOP to a message to opt out of further texts to that number, or HELP for help; you can also email support@mysantaletters.com. Mobile carriers are not liable for delayed or undelivered messages.

9. Intellectual Property

All content, designs, and materials on the Service are the property of My Santa Letters or its licensors. You may not reproduce, distribute, or create derivative works from any content on the Service without our prior written consent.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

To the fullest extent permitted by law, My Santa Letters shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting an updated version on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
